2. DEFINITIONS
- The Agency: Illa Kuntur Travel & Wellness
- The Client: Natural or legal person who contracts the services
- Services: Tours, tour packages, wellness programs, reservations, and related services
- Provider: Hotels, transportation companies, restaurants, wellness centers, and other tourism service providers
- Contract: Agreement between the agency and the client for the provision of services
Accessing, browsing, and using the Illa Kuntur Travel & Wellness website, as well as contracting any of our tourism services, implies the express and unreserved acceptance of these Terms and Conditions by the user or client.
- By using our website and making a reservation, the user declares:
- That they have read and fully understood this document.
- That they are of legal age (18 years or older) and have sufficient legal capacity to enter into a contract.
- That the data provided during the registration or reservation process is true, complete, and up-to-date.
- That they agree to comply with the obligations established in these Terms and Conditions.
- If the user does not agree with any of the provisions contained herein, they must refrain from using this website or contracting our services.

- Accommodation in hotels according to the contracted category
- Meals according to the selected plan (breakfast, half board, or full board)
- Professional bilingual tour guide (Spanish/English)
- Entrance fees to mentioned archaeological sites and museums
- Basic travel insurance during the contracted services
- 24/7 coordination and assistance during the trip
- Briefing session before the start of the tour
- Welcome kit with tourist and wellness information
- Airport/station assistance (when specified)
- Certificate of participation in specialized tours or wellness experiences
- Round-trip tourist transportation
- Specialized tour guide
- Entrance fees to visited sites
- Typical lunch (when specified)
- Insurance during the tour
- Custom itinerary design
- Selection of providers based on preferences
- Specialized accompaniment
- Exclusive VIP or wellness services under quotation
- International flights (unless otherwise specified)
- Personal expenses (drinks, calls, laundry, tips)
- Meals not specified in the itinerary
- Optional activities not included in the program
- International travel insurance (we recommend purchasing it independently)
- Excess baggage fees
- Entrance to Huayna Picchu (subject to availability and additional payment)
- Medical services and medications
- Visas and immigration documents
- Country departure taxes
- Stay extensions for reasons beyond the agency’s control
To access the services offered by Illa Kuntur Travel & Wellness, the client must complete a booking process that will only be confirmed when the following conditions are met:
7.1. BOOKING PROCESSThe client must provide true and up-to-date personal information (full name, ID or passport number, nationality, email, and contact phone number).
Bookings are subject to the availability of spaces, tickets, accommodation, transportation, and other services involved in the itinerary.
A booking confirmation will be sent via email or WhatsApp once the initial or full payment is received, as applicable.
7.2. PaymentsService prices are expressed in US dollars (USD) or Peruvian soles (PEN), as indicated in the quotation or proposal.
- Payment can be made by:
- Bank transfer.
- Direct deposit.
- Credit/debit cards.
- Authorized online payment gateways.
The client assumes the costs of bank commissions, international transfer fees, or other expenses associated with the chosen payment method.
7.3. Payment ConditionsTo confirm the booking, a down payment may be required (usually between 30% and 50% of the total value), depending on the contracted service.
The full payment must be completed within the period indicated in the confirmation and before the start of the trip or tour.
If the client fails to meet the payment deadlines, Illa Kuntur Travel S.A.C. reserves the right to cancel the booking without any obligation to refund the down payment already made.
7.4. Proof of PaymentOnce payment is received, the corresponding receipt (ticket or invoice) will be issued, in accordance with the current tax regulations in Peru.
8. CANCELLATIONS AND REFUNDSAt Illa Kuntur Travel & Wellness, we understand that unforeseen events may arise that require canceling or modifying a trip. Therefore, we establish the following conditions:
8.1. Cancellation RequestAll cancellations must be communicated in writing via email or WhatsApp, indicating the full name of the reservation holder and the details of the contracted service.
The date on which the notification is received will be used to calculate the corresponding penalty charges.
8.2. Refund PoliciesSome services, such as entrance tickets to Machu Picchu, trains, and certain accommodations, are non-refundable due to the policies of external providers.
Applicable refunds will be made after deducting administrative expenses, bank commissions, and penalties imposed by the involved providers.
The refund will be processed within 15 to 30 business days following the confirmation of the cancellation.
8.3. Modifications and ReschedulingThe client may request changes to dates or itineraries. These will be subject to availability and possible additional charges.
Illa Kuntur Travel & Wellness will do its best to offer alternatives of equal or higher quality, informing of any price difference.
8.4. Cancellations due to Force MajeureIn case of circumstances beyond our control, such as:
- Adverse weather conditions.
- Strikes, demonstrations, or blockades.
- Natural disasters.
- Government or health restrictions.
Illa Kuntur Travel & Wellness reserves the right to reschedule the contracted services or propose equivalent alternatives. In these cases, we will not assume responsibility for additional expenses the client may incur (flights, insurance, external lodging, among others).
9. CUSTOMER RESPONSIBILITIESBy contracting any of the services of Illa Kuntur Travel & Wellness, the client accepts and commits to fulfilling the following responsibilities:
9.1. Personal InformationProvide true, complete, and up-to-date personal data at the time of booking (name, identity document or passport, nationality, email, and contact number).
Inform in advance about medical conditions, allergies, dietary restrictions, or special needs in order to assess the feasibility of the service.
9.2. Documentation and Travel RequirementsHave a valid passport or identity document, as well as any visas or other permits necessary to travel within or outside of Peru.
Assume responsibility for any problem that arises due to expired, incorrect, or incomplete travel documents.
9.3. Conduct During ToursRespect the safety rules, schedules, and instructions given by guides, drivers, or authorized personnel.
Maintain appropriate behavior with the group, guides, local community, and the environment.
Not participate in illegal activities or endanger one’s own safety or that of others.
9.4. Health and Physical ConditionIt is acknowledged that some tours include hiking, high-altitude activities, or other physical demands. The client is responsible for assessing their health condition before participating.
It is recommended to have travel insurance that covers accidents, medical emergencies, and cancellations.
9.5. Payments and Financial ObligationsComply with the established payment deadlines for the confirmation and execution of services.
Assume additional costs not included in the contracted package (tips, personal expenses, extra services, etc.).
10. RESPONSIBILITIES OF ILLA KUNTUR TRAVEL & WELLNESSIlla Kuntur Travel & Wellness is committed to providing tourism services with professionalism, safety, and transparency, ensuring the best possible experience within its sphere of control.
10.1. Provision of ServicesComply with the itineraries, services, and activities contracted by the client, according to the booking confirmation.
Select and coordinate with reliable and certified providers (transportation, accommodation, guides, and others).
Provide assistance and support to the client before, during, and after the trip.
10.2. Information and TransparencyProvide clear and truthful information about tours, itineraries, prices, and conditions.
Communicate in a timely manner any modification, cancellation, or situation that affects the development of the service.
10.3. Safety and Well-beingImplement safety and prevention measures during tourist activities.
Ensure that guides and staff are trained in basic first aid and are familiar with emergency protocols.
10.4. Limitations of LiabilityIlla Kuntur Travel S.A.C. is not responsible for situations beyond its direct control, such as:
- Delays, loss of flights, or connections.
- Personal accidents caused by the client’s imprudence.
- Loss, theft, or damage to personal belongings.
- Strikes, natural disasters, government restrictions, or other force majeure events.
In the event that a service cannot be performed due to external causes, Illa Kuntur Travel & Wellness commits to:
- Rescheduling the affected activity, or
- Offering alternatives of equal or greater value, always informing the client of the available options.
All content available on the Illa Kuntur Travel & Wellness website and its official channels (social media, digital or printed material) is protected by intellectual property and copyright laws.
11.1. Protected ContentProtected content includes, but is not limited to:
- Texts, itinerary descriptions, and informational articles.
- Photographs, videos, and audiovisual material.
- Logos, trademarks, trade names, and graphic designs.
- Downloadable digital documents, presentations, and promotional material.
The user may view, download, or print material from the website solely for personal and informational use, without commercial purposes.
Any improper use, copying, distribution, modification, reproduction, or commercial exploitation of the content without written authorization from Illa Kuntur Travel & Wellness is strictly prohibited.
11.3. Rights ReservedIlla Kuntur Travel & Wellness reserves all rights not expressly granted in this document. Failure to comply with these provisions may result in legal action in accordance with applicable Peruvian and international law.
12. INSURANCE AND COVERAGE- All our packages include basic tourist assistance coverage, limited to immediate care in emergency cases.
- We strongly recommend all passengers to purchase a comprehensive independent travel insurance, which includes: international medical assistance, accidents, pre-existing or unforeseen illnesses, loss of luggage, flight cancellations or delays, repatriation, among others.
- Illa Kuntur Travel & Wellness is not responsible for medical expenses, transfers, or incidents not covered by the basic policy or by insurance contracted directly by the passenger.
Illa Kuntur Travel & Wellness will not be liable for changes, delays, cancellations, or modifications caused by force majeure events, including but not limited to: natural disasters (earthquakes, floods, heavy rains, landslides), strikes, labor disputes, health emergencies, acts of terrorism, social unrest, government restrictions, closures of archaeological sites, or climatic problems affecting the itinerary.
- In these cases, the following measures will apply:
- Viable alternatives will be sought to continue the trip.
- Additional expenses generated by changes in transportation, accommodation, or other services will be assumed by the passenger.
- No refunds will be made for unused services due to causes beyond the agency’s control.
Any minor traveling without their parents must have the corresponding notarial and consular authorization, as required by the immigration authorities of Peru and the country of origin.
It is the client’s responsibility to manage these documents; Illa Kuntur Travel & Wellness assumes no responsibility for travel impediments caused by a lack of authorization.
Discount policies on tour packages:
- Children from 3 to 11 years old: 20% discount on the adult rate (sharing a bed with their parents).
- Adolescents from 12 to 17 years old: 10% discount on the adult rate.
- Children from 0 to 2 years old: Do not pay for tourist services, unless they require an additional seat or bed.
- At all times, minors must be under the supervision of a responsible adult.
In case of discrepancies or conflicts, Illa Kuntur Travel & Wellness and the client commit to seeking a solution through:
- Direct and conciliatory dialogue.
- Mediation before INDECOPI, following the consumer protection mechanisms in Peru.
- Arbitration under Peruvian law, if the parties so agree.
- If the conflict persists, the parties expressly submit to the jurisdiction of the courts of Cusco – Peru.
Illa Kuntur Travel & Wellness makes the following formal complaint channels available to clients:

- Subject: Complaint PX-(travel group name)
- Message: Include a full detail of the case, date of service, names of participants, and attach evidence (photos, videos, receipts, etc.) if any.
- All complaints will be answered within a maximum period of 15 business days, in accordance with Peruvian consumer protection regulations.
These terms and conditions come into effect as of September 2025.
- Illa Kuntur Travel & Wellness reserves the right to modify, update, or supplement these terms without prior notice.
- Modifications will be published on our official website and communicated directly to clients with confirmed and active reservations.
- The continued use of our services implies acceptance of the updated conditions.

18.2. Response TimeWe commit to responding within a maximum period of 5 business days from the receipt of the query or request. In complex cases, this period may be extended, which will be duly communicated to the client.
18.3. Valid Communication ChannelsOnly communications sent to the official channels mentioned will be considered valid.
Illa Kuntur Travel & Wellness is not responsible for requests sent to unauthorized addresses, numbers, or accounts.
